PART II — PRIVACY POLICY
For purposes of these Terms, the following shall have the meanings set forth below: "Philippine Lands," "we," "us," or "our" refers to the operator of the Philippine Lands website and related services. "Platform" means the Philippine Lands website, mobile application, APIs, and any other online services operated by us. "User," "you," or "your" means any person who accesses or uses the Platform. "Seller" means any User who posts or advertises real property on the Platform. "Buyer" means any User who browses or expresses interest in listed property. "Listing" means any advertisement relating to a property uploaded by a Seller. "Content" means any material submitted by any User. "Transaction" means any negotiation, sale, lease, or other disposition of real property between a Buyer and a Seller. "DPA" means Republic Act No. 10173, the Data Privacy Act of 2012. "NPC" means the National Privacy Commission.
Philippine Lands operates an online classifieds-style platform that enables prospective sellers and lessors of Philippine real property to publish Listings, and enables prospective buyers, lessees, and investors to browse those Listings and contact the respective Sellers. The Platform is intended solely as a venue for the publication of Listings and the facilitation of communication between Users. Philippine Lands does not participate in, supervise, guarantee, endorse, or underwrite any Transaction.
3.1 Platform-Only Role. Philippine Lands is a neutral online platform. We are not a party to any Transaction, contract to sell, deed of sale, lease, or other arrangement arising between Users. We have no beneficial interest in any Listing. Listings are created, uploaded, priced, and managed entirely by Sellers.
3.2 No Brokerage, No Agency, No Fiduciary Relationship. Nothing in these Terms shall be construed as creating any brokerage, agency, partnership, employment, fiduciary, or similar relationship between Philippine Lands and any User. Philippine Lands is not a real estate service practitioner under Republic Act No. 9646. Users who engage in real estate service on the Platform warrant that they are duly licensed.
3.3 No Verification of Listings. Philippine Lands does not independently verify and makes no warranty regarding: (a) the identity of any User; (b) the truth or accuracy of any Listing; (c) the existence, condition, or title of any property; (d) the authority of any Seller; (e) liens, adverse claims, litigation, or encumbrances; (f) the accuracy of any title, tax declaration, or plan; or (g) whether any Transaction will be consummated.
3.4 No Guarantee of Outcomes. Philippine Lands makes no guarantee that any Listing will generate inquiries or sales, that any Seller is the lawful owner, or that the Platform will be free from fraudulent Listings or misuse.
4.1 Eligibility. To use the Platform, you must be at least eighteen (18) years of age and possess the legal capacity to enter into binding contracts under Philippine law.
4.2 Registration. You agree to provide true, accurate, and complete information and to keep it updated. You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account.
4.3 Foreign Ownership. Users acknowledge that Philippine law imposes restrictions on land ownership by foreign nationals and corporations with foreign equity exceeding 40%. Users are solely responsible for ensuring Transaction compliance.
You agree not to: post any Listing for property you are not authorized to offer; post Listings with false or misleading information; post duplicate or spam Listings; circumvent any security or moderation feature; scrape or harvest Content without consent; use the Platform for money laundering, tax evasion, or fraud; post libelous, obscene, or harassing Content; solicit information from minors or impersonate any person; upload malicious code; or transmit unsolicited commercial communications.
6.1 Seller Representations. By posting a Listing, the Seller represents and warrants that they are the lawful owner or duly authorized in writing; the property has a clean, marketable title or all encumbrances are fully disclosed; the Listing is accurate and not misleading; and the Seller shall comply with Republic Act No. 6552, PD 957, BP 220, and all other applicable Philippine real estate laws.
6.2 License to Content. By submitting Content, you grant Philippine Lands a non-exclusive, worldwide, royalty-free license to use, reproduce, publish, and distribute such Content for operating and promoting the Platform.
6.3 Moderation. Philippine Lands reserves the right to review, refuse, delete, or de-index any Listing or Content at its sole discretion, without prior notice and without liability.
Buyers expressly agree to conduct thorough independent due diligence before committing to any Transaction, including: obtaining a certified true copy of the TCT/CCT from the Registry of Deeds; securing an updated tax declaration and tax clearance; physically inspecting the property; engaging a licensed geodetic engineer; checking zoning, land use, hazard zones, and ancestral domain coverage; consulting a licensed real estate broker, attorney, and appraiser; refusing to make cash payments to unknown parties without proper documentation; and verifying Seller identity. Philippine Lands does not perform any of the foregoing checks and shall have no liability for a User's failure to do so.
Philippine Lands may charge fees for premium listing placement, featured promotion, verification badges, or other services. Such fees are generally non-refundable. Unless expressly offered as an add-on, Philippine Lands does not process or escrow payments for Transactions. Users are solely responsible for all taxes arising from any Transaction, including capital gains tax, documentary stamp tax, transfer tax, and all related fees.
THE PLATFORM, ALL LISTINGS, AND ALL CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND. Philippine Lands expressly disclaims any warranty that the Platform will be uninterrupted or error-free, or that any Listing, Seller, Buyer, property, price, document, or Transaction is authentic, legitimate, lawful, or safe.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, Philippine Lands and its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform or any Transaction. In no event shall the aggregate liability of Philippine Lands exceed the greater of (a) the total fees paid by you to Philippine Lands in the preceding twelve (12) months, or (b) One Thousand Pesos (₱1,000.00). Nothing herein excludes liability for fraud, willful misconduct, or gross negligence.
You agree to defend, indemnify, and hold harmless Philippine Lands and its directors, officers, employees, and affiliates from any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Platform; (b) your Content or Listings; (c) your violation of these Terms or any applicable law; (d) any Transaction to which you are a party; or (e) any dispute between you and another User.
All rights in and to the Platform, including its design, software, logos, trademarks, and compilations, are the exclusive property of Philippine Lands or its licensors, protected by the Intellectual Property Code (RA 8293). No portion of the Platform may be copied, modified, or exploited without prior written consent. If you believe your copyright has been infringed, please notify us at admin@philippinelands.com.
The Platform may contain links to third-party websites, maps, tools, and directories. Such resources are provided for convenience only. Philippine Lands neither endorses nor is responsible for their content or practices. Your use of third-party services is governed by their respective terms and privacy policies.
Philippine Lands may suspend, limit, or terminate your access, delete your account, remove your Listings, or refuse service at its sole discretion and without prior notice if you have violated these Terms, applicable law, or the rights of any third party. Provisions that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution — shall survive.
These Terms shall be governed by the laws of the Republic of the Philippines. Before initiating any formal proceeding, the parties agree to attempt good-faith negotiation for not less than thirty (30) days. Unresolved disputes shall be submitted to the competent courts of the Philippines. Philippine Lands is not obligated to mediate disputes between Users. Users release Philippine Lands from claims arising from such disputes.
We may update these Terms from time to time. We will revise the "Last Updated" date and provide reasonable notice for material changes. Your continued use of the Platform after the effective date constitutes acceptance of the revised Terms.
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Philippine Lands. If any provision is held invalid or unenforceable, the remaining provisions shall remain in full force. Our failure to enforce any right shall not constitute a waiver. You may not assign these Terms without our prior written consent. Philippine Lands shall not be liable for failure or delay due to causes beyond its reasonable control, including typhoons, pandemics, acts of government, or cyberattacks.
Philippine Lands respects your right to privacy. This Privacy Policy describes how we collect, use, store, share, and protect personal data obtained when you access or use the Platform. It is issued in compliance with the Data Privacy Act of 2012 (RA 10173) and relevant NPC issuances. Philippine Lands is the Personal Information Controller (PIC) for personal data collected through the Platform.
19.1 Information You Provide: Account information (name, email, mobile, password, profile photo, business name, TIN for Sellers); Listing information (property address, photos, videos, price, title number, and other details); Verification information (government-issued ID, SPA, Board Resolution, or PRC license where applicable); Communications (messages to other Users, inquiries, support requests); and Transactional information (billing details for fees paid).
19.2 Information Collected Automatically: Device and log data (IP address, browser type, pages viewed, timestamps); Location data (approximate from IP, or precise with your consent); Cookies and similar technologies.
19.3 Information from Third Parties: We may receive information from social-login providers, payment processors, analytics providers, and fraud-prevention vendors.
19.4 Sensitive Personal Information: We generally do not require sensitive personal information. Where necessary (e.g., government ID for identity verification), it is collected only with your consent and processed only for the specific purpose for which it was collected.
We use your personal data to: create and manage your account; publish and display your Listings; enable Buyer-Seller communications; process fees and issue receipts; provide customer support; send security alerts and administrative messages; personalize and improve the Platform; detect and prevent fraud; send marketing communications (with opt-out option); and comply with legal obligations including those of the NPC, BIR, and AMLC.
We process personal data based on: (a) your consent; (b) necessity for the performance of our contract with you; (c) compliance with a legal obligation; (d) protection of vital interests; and (e) pursuit of our legitimate interests, subject to a balancing test against your rights and freedoms.
We do not sell personal data. We share personal data only: with other Users (information in your public profile or Listing); with service providers (hosting, analytics, payment processing, email delivery) bound by data-processing agreements; with professional advisers; in a corporate transaction (merger, acquisition) subject to confidentiality undertakings; for legal and safety reasons; and with your consent.
The Platform uses cookies, pixels, and similar technologies for essential functions (keeping you signed in), performance analytics, personalization, and advertising. Where required by law, we obtain your consent. You may manage cookie preferences through your browser settings; however, disabling certain cookies may impair Platform functionality.
We retain personal data for as long as necessary to fulfill the purposes described in this Policy, or as required by law (e.g., for tax, accounting, or anti-money-laundering purposes). When no longer necessary, personal data is securely deleted, anonymized, or archived in accordance with NPC Circular No. 16-01.
Philippine Lands implements reasonable organizational, physical, and technical security measures including access controls, encryption in transit, secure password hashing, periodic vulnerability testing, and employee training. No transmission or storage method is completely secure. In the event of a personal data breach, we shall notify the NPC and affected data subjects within the periods prescribed by law.
Under the DPA, you have the right to: be informed about the collection and processing of your personal data; access a copy of the personal data we hold; object to processing, including for direct marketing; erasure or blocking of personal data under qualifying circumstances; rectification of inaccurate data; data portability; file a complaint with the National Privacy Commission; and damages for violations of your rights. To exercise these rights, contact our Data Protection Officer at admin@philippinelands.com.
The Platform is intended for users aged eighteen (18) and above. We do not knowingly collect personal data from minors. If we become aware of such collection without valid parental consent, we will delete such data promptly.
Some of our service providers are located outside the Philippines. Where we transfer personal data across borders, we ensure adequate safeguards are in place — such as contractual clauses requiring a level of protection comparable to the DPA. By using the Platform, you acknowledge such transfers.
We may update this Privacy Policy from time to time. Material changes will be notified through the Platform or by email at least fifteen (15) days in advance where required by law. The "Last Updated" date reflects the most recent revision.

By posting your land on Philippine Lands, you agree to the following:
Public Information. The land details you provide — location, area, price, description, photos, and other listing information — will be publicly displayed on the platform and may be viewed, shared, and accessed by users and non-users.
Legal Documents — Confidentiality. The legal documents you submit, including Titles, Tax Declarations, Tax Maps, Subdivision Plans, LTS, TLTS, and government-issued IDs, will NOT be disclosed to any third party. These remain strictly confidential and are used solely for internal verification.
Summary for Verification. A summary of your legal documents will be prepared for verification purposes. This summary may be shared with users or non-users who request a Verification Report of your listing. The original legal documents themselves will never be released.
Verification Reports. Any party requesting a Verification Report of your post shall pay a nominal fee to Philippine Lands. This fee covers the cost of verification and is not shared with you, the poster.
No Fees from Philippine Lands. You acknowledge and guarantee that you shall NOT request, demand, or collect any fee, commission, or compensation from Philippine Lands in connection with your listing or any verification activity related to it.
Accuracy of Information. You confirm that the information and documents you submit are true, accurate, and that you have the legal right to list the property.
Activation. Your listing becomes active only upon your agreement to these terms.

This means that the user posting the property has requested Philippine Lands to conduct a "facial" / surface-level / basic review of the documents submitted. Philippine Lands requires four (4) core documents: the Title (TCT or OCT), Tax Declaration, Authority to Sell or Special Power of Attorney (SPA), and Subdivision Plan or Tax Map. A listing may be marked as "verified" if at least two (2) of these documents are submitted, provided that either the Title or the Tax Declaration is included.
Philippine Lands does not make any guarantee that the person listing is the same as the owner of the land. If the user can submit proof of his identity through valid government ID, the user will be marked as verified.
The Verification Report is prepared by the Philippine Lands legal and verification team and reflects the status of documents submitted by the seller at the time of listing. It is not a substitute for independent legal due diligence. Philippine Lands does not guarantee the accuracy, completeness, or legal validity of any document reviewed. Buyers and investors are strongly advised to engage their own counsel before entering into any transaction. The report is prepared for informational purposes only and does not constitute legal advice, title insurance, or any form of warranty as to the condition or ownership of the property. Philippine Lands assumes no liability for losses, damages, or disputes arising from reliance on the Verification Report, whether in whole or in part. The report will be sent to the email address provided by the requesting party. Philippine Lands reserves the right to decline any request that does not meet its verification standards or where documents are insufficient or incomplete.
No. Philippine Lands does not disclose or furnish copies of the seller's legal documents to the requesting party. The Verification Report will only summarize the documents reviewed and indicate their apparent status based on a facial examination. This policy is intended to protect the privacy, security, and proprietary interests of the document owner. Any party who wishes to obtain copies of the underlying documents must coordinate directly with the seller or the authorized representative. Philippine Lands is not a custodian of title and does not have authority to release, certify, or authenticate such documents on behalf of the owner.
